(Order No. 28 of the State Electricity Regulatory Commission) Measures for the Administration of Permits for Testing (Repairing, Installing) Power Facilities
Article 6: Permits are divided into three categories: installation, repair, and testing.
Those who obtain an installation permit can engage in installation activities of power facilities.
Those who obtain a repair permit can engage in maintenance activities of power facilities.
Those who obtain a testing permit can engage in testing activities of power facilities.
Article 7: Permits are divided into levels 1, 2, 3, 4, and 5.
Those who obtain a level 1 permit can engage in installation, repair, or testing activities of power facilities at all voltage levels.
Those who obtain a level 2 permit can engage in installation, repair, or testing activities of power facilities with voltage levels below 220kV.
Those who obtain a level 3 permit can engage in installation, repair, or testing activities of power facilities with voltage levels below 110kV.
Those who obtain a level 4 permit can engage in installation, repair, or testing activities of power facilities with voltage levels below 35kV.
Those who obtain a level 5 permit can engage in installation, repair, or testing activities of power facilities with voltage levels below 10kV.
Chapter 3: Application, Acceptance, Review, and Decision
Article 8: An application for a permit should be submitted to the dispatched agency where the applicant is located.
Only after obtaining the permit can the applicant apply to the administrative department for industry and commerce for a business license or change the business scope.
Article 9: To apply for a permit, the following conditions should be met:
(1) Having legal person qualification;
(2) Having registered capital commensurate with the applied permit category and level;
(3) Having equipment and business premises commensurate with the applied permit category and level;
(4) The technical director and safety director should have qualifications commensurate with the applied permit category and level, and cannot hold positions in other units simultaneously;
(5) Having full-time professional personnel commensurate with the applied permit category and level;
(6) Having a sound and effective safety production organization and system.
For applications for level 1 to level 3 permits, relevant performance records should also be provided.
The specific application conditions for different categories and levels of permits will be formulated separately by the State Electricity Regulatory Commission and announced to the public.
Article 10: To apply for a permit, the following materials should be submitted:
(1) Permit application form;
(2) Legal person certification materials and net asset certification materials;
(3) List of main equipment and tools, and business premises certification materials;
(4) Resumes of the technical director and safety director, professional and technical qualification certificates, and other certification materials;
(5) Detailed list of professional and technical personnel, professional and technical qualification certificates or training qualification certificates, and other certification materials;
(6) Registration form for electricians;
(7) Certification materials for safety production organization and system.
For applications for level 1 to level 3 permits, relevant performance reports and certification materials should also be submitted.
Article 11: If a newly established unit after merger applies for a permit, in addition to the materials specified in Article 10, the following materials should also be submitted:
(1) Certification materials for the merger;
(2) Permits of each unit before the merger.
Article 12: If a newly established unit after division applies for a permit, in addition to the materials specified in Article 10, the following materials should also be submitted:
(1) Certification materials for the division;
(2) Performance certification materials;
(3) Permit of the unit before the division.
After division, at most one unit may partially or wholly continue the performance of the pre-division unit in similar activities.
Article 13: Upon receiving an application, the dispatched agency should review whether the application materials are complete and conform to legal forms. The dispatched agency has the right to require the applicant to explain or clarify the application matters.
Article 14: The dispatched agency should handle the application submitted by the applicant according to the following situations:
(1) If the application materials contain errors that can be corrected on the spot, the applicant should be allowed to correct them on the spot;
(2) If the application materials are incomplete or do not conform to legal forms, a notice of correction of application materials should be issued to the applicant on the spot or within five days, and all the contents that need to be corrected should be informed at one time;
(3) If the application materials are complete and conform to legal forms, or the applicant submits all corrected application materials as required by the dispatched agency, a notice of acceptance should be issued to the applicant.
